All our new products are covered by the seller’s legal warranties: the warranty of conformity and the warranty against hidden defects. Here is what they cover, how long you have to act and how to contact us.

The legal warranty of conformity

The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for lack of conformity resulting from the packaging, the assembly instructions or the installation where this was made the seller’s responsibility under the contract or was carried out under the seller’s responsibility.

  • The goods must be fit for the purposes for which goods of the same type are normally used.
  • They must correspond to the description given by the seller and display the qualities presented.
  • They must display the qualities that a buyer can legitimately expect having regard to public statements made by the seller or the producer, notably in advertising or labelling.
  • The warranty lasts two years from delivery of the goods. Any defect that appears within 24 months of delivery of a new item is presumed to have existed at the time of purchase: you do not have to prove that it was already there.
  • These rules are set out in articles L217-3 to L217-20 of the French Consumer Code.

The warranty against hidden defects

The seller is bound by a warranty in respect of hidden defects in the thing sold which make it unfit for the use for which it is intended, or which so impair that use that the buyer would not have acquired it, or would have given a lower price for it, had he known of them. The action must be brought within two years of the discovery of the defect.

The manufacturer’s warranty

New products are guaranteed 2 years by their manufacturer. The conditions of this warranty (cover, exclusions) are in the product manual or documentation. For any question about the warranty of a specific product, contact us before or after purchase.

How to claim under warranty

  1. Contact our after-sales service, giving your order number, the product and the defect observed (see After-sales service).
  2. Wait for our written agreement: no return of equipment is accepted without the express written agreement of our departments, even under warranty.
  3. Send the product back to the address provided, with your invoice; outward shipping costs are borne by the customer, except where the product is non-compliant.

What the warranty does not cover

Pompes-H2O cannot be held liable for the consequences of misuse of the products sold, nor for force majeure, fault on the part of the customer or an unforeseeable and insurmountable act of a third party (§ 9 of the terms and conditions of sale).
