Terms and conditions of sale

These terms and conditions of sale govern the relationship between any user of the Pompes-H2O.com website and the Pompes-H2O.com trading name. They apply to each order, in the version in force on the date of the order.

1 – Introduction

The terms and conditions of sale set out below (hereinafter the “General Terms”) govern the contractual relationship between any user of the Pompes-H2O.com website (hereinafter a “User” or “You”) and the Pompes-H2O.com trading name. These terms and conditions of sale are the only ones that apply and replace all other conditions, unless a prior, express and written derogation has been agreed.

Pompes-H2O may occasionally amend some of the provisions of its general terms, so they should be re-read before each visit to the Pompes-H2O.com website (hereinafter the “Site”). These amendments are enforceable from the time they are put online and cannot apply to contracts concluded previously. Each purchase on the site is governed by the general terms applicable on the date of the order.

We consider that, by confirming your order, you accept our terms and conditions of sale without reservation after having read them. By accessing the Site, you undertake to comply with the General Terms and with the Terms of Use set out therein.

2 – Order

To place your order, we provide you with two means:

• via the Internet on our Pompes-H2O.com site, 24 hours a day, 7 days a week;
• by e-mail: contact@pompes-h2o.com.

3 – Products

Pompes-H2O takes the greatest care in putting online information on the essential characteristics of the products, notably by means of technical descriptions provided by its partners and suppliers and photographs illustrating the products, within the limits of the available technology and in compliance with the best market standards. Products are subject to change without notice.

Product availability: Pompes-H2O expressly states that the stock displayed is indicative only and is not updated in real time.

4 – Prices

The selling prices shown on the site are in euros, including all taxes but excluding delivery costs. Any delivery costs are shown to the User as he or she selects products and are invoiced at the end of the order, in addition to the price of the selected products.

The price to be paid is in euros and is always clearly shown before the order is confirmed. We reserve the right to change our prices at any time, but we undertake to apply the prices in force that were shown to you on the Site at the time of your order.

5 – Delivery

Products purchased on the Pompes-H2O.com site are delivered to mainland France, Corsica, the French overseas departments and territories (DROM-TOM), Europe and the rest of the world. Your order will be delivered to the address you gave us when you placed your order. Delivery is carried out by La Poste or another carrier. Transport costs are borne by the customer; they depend on the delivery zone (see the Delivery page).

Lead time: delivery will take place within 2 to 5 days if the product is available; otherwise you will be notified by e-mail of the delay and will have the option to cancel if you wish, in which case we will refund you immediately if you paid by bank card.

Delivery by carrier: from the day you are notified, you must contact the carrier to arrange an appointment, which must take place within 5 working days. Otherwise, storage fees will be invoiced to you.

Returned products can only be accepted if they are in their original condition, namely with their packaging, accessories and operating instructions (see § 8).

6 – Payment and administrative payment order

Payment terms: unless special conditions are expressly stated, or specific conditions are granted to business customers after review of their file, payments must be made by bank transfer (transfer fees are borne by the buyer) or bank card. Pompes-H2O provides you with several payment methods.

Online payment by credit card is made via the “Sogecommerce” security system of SOCIETE GENERALE, which encrypts your bank details when they are transmitted over the network. We no longer accept cheques.

Administrative payment order

For payments by administrative payment order, you must select payment by bank transfer and provide us with your SIRET number and commitment number, if you have one. We will then upload the invoice directly to the Chorus Pro website (see Payment by administrative order).

7 – Right of withdrawal

Pompes-H2O allows you 14 calendar days (article L221-18 of the Consumer Code) to return to us a new product that does not satisfy you. This right of withdrawal is exercised without penalty, except for shipping costs.

Within this period you may return the product, at your own expense, together with your invoice and the duly completed and signed return form. We ask that you return the goods by registered post or tracked post and take out insurance with the carrier for the market value of the products. This is particularly necessary in the event of theft or loss of the goods by their services. In all cases the return is made at the consumer’s expense.

Refund period (article L221-24): when the right of withdrawal is exercised, Pompes-H2O refunds the consumer without undue delay and at the latest within 14 days of the date on which it was informed of the decision to withdraw. The refund is made by the same means of payment as the one used for the purchase.

8 – Returns and take-back of new equipment

For any return of parcels, you must return them to us by La Poste (or another carrier). Please note that shipping costs for the outward journey are borne by the customer, except where the product is non-compliant. If it is an ordering error by the customer, the shipping is at their expense.

No return of new equipment will be accepted without the express written agreement of our departments, even under warranty. A deduction of 15% will be made from the take-back price in the event of a return of new equipment within two months at most of the invoice date. An additional reduction in value may be applied if repackaging is necessary in order to put the returned equipment back on the shelf.

We do not refund hoses bought cut to length, crimped hoses, or other products or assemblies made or assembled to measure.

9 – Disputes and liability

This contract is subject to French law. Pompes-H2O cannot be held liable for non-performance of the contract concluded, firstly in the event of force majeure, as defined by the French courts, and secondly in the event of fault on the part of the customer or an unforeseeable and insurmountable act of a third party to the contract. Pompes-H2O cannot be held liable for the consequences resulting from the misuse of the products sold on the site.

10 – Protection of personal data

By registering on the site, you undertake to provide us with sincere and truthful information about yourself. Providing false information is contrary to these general terms and to the terms of use set out on the Site.

In accordance with the “Informatique et Libertés” law, the processing of your information has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL). Pompes-H2O is authorised to collect, process and use the information concerning you. This data is subject to computer processing. This activity is strictly regulated: the file has been declared to the Commission Nationale Informatique et Libertés under receipt number n° 1564747.

You have a permanent right of access to and rectification of all data concerning you, in accordance with European texts and national laws in force (article 34 of the law of 6 January 1978). You may at any time make a request to Pompes-H2O to find out what information it holds about you. You may at any time, on request, modify this data.

If you accepted this when identifying yourself on the Site, promotional e-mails offering you new products, clearance offers, exclusives, bargains, etc. will be sent to you. You may ask to stop receiving e-mails from us at any time by clicking on the link provided for this purpose and inserted in the footer of each of the e-mails that we or one of our partners send you.

Pompes-H2O is the sole holder of the information concerning you. If you accepted this when identifying yourself on the site, Pompes-H2O and its contractual partners may send you information in the context of specific and occasional promotional operations. These partners are specially chosen by Pompes-H2O and are recognised for the quality of their products and services.

Appendix – Legal warranties

Legal warranty of conformity (articles L217-3 to L217-20 of the Consumer Code): the seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The warranty lasts two years from delivery of the goods; any defect that appears within 24 months of delivery of a new item is presumed to have existed at the time of delivery.

Article 1641 of the Civil Code: “The seller is bound by a warranty in respect of hidden defects in the thing sold which make it unfit for the use for which it is intended, or which so impair that use that the buyer would not have acquired it, or would have given a lower price for it, had he known of them.”

Article 1648, paragraph 1, of the Civil Code: “Actions arising from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.”
